Trey was defending a driver charged with a felony DUI before a jury. Another driver had seen her weave across her lane and called the police. A police officer started following her and although she drove for several miles without any traffic violations, the officer pulled her over based on what the other driver had reported. He smelled an odor of alcohol and asked her to perform field sobriety tests. She failed them and he arrested her for DUI. At the station she refused the breathalyzer. In closing argument Trey pointed out that when he was in high school, his science teacher said that using scientific principles, he could prove that bumblebees cannot fly. It's true! If you apply the principles of aerodynamics, bumble bees should not be able to fly. Their wings are too small, they don't beat them fast enough, and their bodies are too big. Apparently bumblebees never studied science. We know they can fly. We've seen them fly. Still the National Highway Traffic Association has conducted a number of "scientific" studies to show that persons who fail tests like the one-leg stand test or the walk and turn test, can't drive safely. The prosecutor argued that the State had proven that Trey's client could not drive safely because they presented evidence that she failed these "scientific" field sobriety tests. Trey reminded the jury that she drove safely for several miles under the watchful eyes of the officer. We know she can drive safely! We watched a video of her driving without any difficulty. A jury agreed and found her "Not Guilty." The following are a couple stories that are true, but a third less serious. Note: Driving under the influence of alcohol or drugs is a serious offense. These stories are not meant to diminish that or otherwise minimize the damage that can be done when someone causes an accident because they are impaired. Story 2. The following is a true story reported by the Missouri Court of Appeals - Several years ago an older man was driving along a country road on November 1 at approximately 2:00 in the morning when he came around a bend and saw a car turned upside down near the side of the road. A tall, muscular young man was standing next to the car. The young man was wearing a full superman costume...cape, tights, the whole bit. The old man slowed his car and look in amazement as the man dressed as Superman was rocking the car back and forth, trying to get it to roll back onto its wheels. The man couldn't believe his eyes! Again, it was 2:00 a.m. on November 1...just a couple hours after Halloween. The young Superman had just come from a Halloween party. Unfortunately for Superman, the old man called the police for help. A State Trooper came to the scene, smelled the odor of alcohol on Superman and no one was laughing from that point on. The trooper arrested Superman for Driving While Intoxicated, and that's how Trey became Superman's attorney. As it turned out there were no eye witnesses that could confirm that Superman had, in fact, ever drove the car and Trey argued that for all anyone knew, the young man inthe cape had simply flown over, saw the wreck and flew down to help. Epilogue: Trey still has the booking room photo of his client holding the booking room number over the 'S' on his chest. Story 3. An Overland Park Police Officer had a man stopped on the side of I-35 and was administering field sobriety tests to the man. As the man was doing the tests another car drove by and quickly pulled to the side of the road. The driver staggered out of the vehicle and stumbled back to where the officer and the man were and said, "Damn, I hate these field sobriety check points!" The Officer asked the man to have a seat in his car and arrested him when he was done with the first driver. Driving under the influence of alcohol or drugs is a serious offense.
